RENT PROTECTION REGULATION

This regulation establishes the terms and conditions of the Rent Protection product, offered by RENTCARS. As this product is an optional rental car reservation, the general Terms and Conditions of RENTCARS also apply, being this regulation supplementary, specifically for the Rent Protection product.

Please read all the rules carefully before purchasing the product.
  1. WHAT IS RENT PROTECTION?
    1. Rent Protection is a product developed and offered by RENTCARS to ensure even more comfort and peace of mind during your rental.
    2. The Rent Protection product aims to provide reimbursement to the renter for the amount paid to the car rental company (hereinafter referred to as “Rental Company”) for the insurance deductible contracted with the Rental Company in case of a claim, up to the limit of R$10,000.00 (ten thousand Reais), meaning you pay the Rental Company the deductible amount as defined in the rental contract and we reimburse this money up to the limit of R$10,000.00 (ten thousand Reais) directly to your account.
    3. It is important to clarify that Rent Protection is not insurance and therefore, contracting it alone does not offer protection against damages arising from the rental, such as collisions or theft, nor does it provide assistance services like towing or mechanical services. Likewise, Rent Protection is also not a brokerage service and therefore RENTCARS does not provide any advice, consulting services, or personalized insurance recommendations, even if these are the insurance services offered by the Rental Companies available on the RENTCARS App or Site. Any questions regarding the type of insurance to be contracted, deductible amounts, coverages, and related matters should be addressed directly with the Rental Company of your choice.
    4. As the insurance policy will be offered by the Rental Company, we cannot intervene with the insurer in case of claims. Therefore, to ensure that you do not face any unpleasant surprises, it is important to keep these recommendations in mind:
      1. Indicate all drivers who may drive the vehicle during the rental, even if for short periods. Remember that every insurance policy is calculated based on various factors, including the drivers of the vehicle. If a claim occurs while a driver who was not reported to the Rental Company is driving the vehicle, there is a possibility that the insurance policy will be triggered and coverage will be denied, and if this happens, Rent Protection cannot be utilized.
      2. Keep all documentation related to the claim, as well as all documentation provided by the Rental Company regarding the insurance claim. This way, if you have any questions or need to contest any points, you will be prepared.
      3. As traffic rules in different countries are different, check with the Rental Company not only the necessary documentation but also any procedures that can and cannot be adopted while driving the vehicle. Some insurance policies have coverage exceptions that may be derived from a local or cultural issue.
      4. Always inform the Rental Company if you intend to make long trips that result in travel to another state or even another country, as there are insurances with territorial limitations and you may end up without coverage in the middle of the trip.
      5. Always clarify all doubts about coverages, deductibles, exceptions, and related matters with the Rental Company. Even if these rules are included in the rental contract, always ask at the counter about anything that may not be clear or if you are unsure. Remember that only the Rental Company can help you with these points.
  2. WHAT DOES IT COVER AND WHAT ARE THE EXCEPTIONS?
    1. The Rent Protection product only provides reimbursement for the cost of the deductible charged by the Rental Company, so additional costs such as transportation costs, assistance, accommodation, attorney fees, and any others, even if related to the claim, are not covered by our product.
    2. As Rent Protection only aims to reimburse the insurance deductible, it is important to check with the Rental Company what the insurance covers, as coverages vary according to each Rental Company, rental location, and other factors.
    3. Pay attention to the coverage exclusions in your insurance policy with the Rental Company. Only the Rental Company and the insurer it contracts can define the coverage and exclusion items. Make sure with the Rental Company that the insurance you contract covers all your needs and ensure that you agree with the coverage denial scenarios.
    4. Remember that every policy has coverage exception scenarios. For example, it is common for these insurances not to cover, among other situations, the following cases:
      1. Violation of traffic laws;
      2. Disrespect for the minimum or maximum allowed age;
      3. Fueling error (use of incorrect fuel);
      4. Claim in an uncovered location (city, state, or country different from where the vehicle was rented);
      5. Mechanical failures due to reckless driving, including driving under the influence of alcohol, controlled medications, or other drugs, even if legal in the rental location;
      6. Damage to lost, stolen, or damaged personal items;
      7. Liability for injuries to passengers or third parties, which usually varies according to the type of policy chosen;
      8. Use of the vehicle on unpaved roads, which is an important point of attention in case of rental in beach or desert locations;
      9. Use of the vehicle for deliveries or commercial purposes;
      10. Driver not indicated in the rental contract as an additional driver;
      11. Absence of valid documentation (such as an international driver's license).
      This list is only illustrative and mentions the most common exclusions, do not forget to check carefully with the Rental Company as there may be other exclusions and conditions in your insurance.
    5. If the claim with the vehicle is not covered by the contracted policy and/or for any reason does not generate the insurance deductible, the payment for damages to the vehicle cannot be used as a basis for the Rent Protection reimbursement request, as our product is limited exclusively to the amount paid as an insurance deductible to the Rental Company.
    6. As RENTCARS has no relationship with the insurer and is not a party to the insurance policy, it also cannot intervene in case of coverage denial. Therefore, any situation in this regard should be addressed directly with the Rental Company or the insurer, as the case may be.
  3. ELIGIBILITY AND HOW TO CONTRACT
    1. To qualify to contract and use Rent Protection, the following requirements must be met:
      1. You must rent a vehicle through the RENTCARS platforms;
      2. In this reservation made with RENTCARS, you must include one of the insurance options offered directly by the chosen Rental Company in your rental;
      3. The claim must be one of the coverage scenarios of the insurance contracted with the Rental Company;
      4. The Rent Protection must be contracted and paid directly with RENTCARS at any time before picking up the vehicle with the Rental Company;
      5. To enjoy the right to reimbursement, the Rent Protection cannot have been canceled at any time before or after picking up the vehicle with the Rental Company;
      6. To enjoy the right to reimbursement, the contracting and payment of Rent Protection must also reflect any changes provided in item 3.6 of these terms and conditions.
    2. As Rent Protection does not offer any type of coverage for claims, but only the reimbursement of the deductible, to contract it you must necessarily also contract some insurance with the Rental Company of your choice. Since this facility aims to reduce your loss with the deductible payment in case of a claim with the vehicle, it is mandatory to have insurance contracted with the Rental Company. The type of insurance you choose should only reflect your rental needs, as Rent Protection can be used with any type of insurance chosen at the Rental Company.
    3. Rent Protection is supplementary in nature and does not replace or alter any existing insurance policy, nor does it provide any guarantees beyond the reimbursement of the deductible cost eventually paid in case of a claim, respecting the maximum limit of R$10,000.00 (ten thousand Reais).
    4. The decision to select Rent Protection is voluntary, meaning the insurance you contract with the Rental Company will not be affected in any way by the contracting of Rent Protection. As the insurance is offered by the Rental Company and Rent Protection by RENTCARS, they operate independently. Remember that Rent Protection can only be effective for use once the insurance with the Rental Company is contracted, as it aims to cover the deductible of a valid insurance linked to the reservation. It is the responsibility of the contractor to ensure that this requirement is met to contract Rent Protection.
    5. The contracting of Rent Protection can be done at any time between the confirmation of the reservation by RENTCARS and the scheduled date for picking up the rented vehicle, and contracting is not allowed after picking up the vehicle. If you wish to contract the product after confirming your reservation, contact our RENTCARS customer service channels, as contracting with the Rental Company is not possible since it is an exclusive product of RENTCARS.
    6. If any adjustment is made to the reservation directly with the Rental Company, such as increasing or decreasing the rental days, changing the vehicle category, etc., you must immediately contact RENTCARS and inform these changes, which may also alter the cost of Rent Protection. If these changes are not informed, the Rent Protection reimbursement will be denied due to changes in the rental contract without prior communication.
  4. CANCELLATION RULES
    1. You can cancel the Rent Protection at any time before picking up the vehicle, remembering that this cancellation must be made through the RENTCARS customer service channels, as cancellation or withdrawal of the contract at the Rental Company's counter at the time of vehicle pickup is not possible.
    2. In case of cancellation, the refund of the amount paid for Rent Protection will be made by credit to the next credit card statements (according to the rules of each operator). In cases where the credit card operator does not allow the operation mentioned here, or in cases of payments made in other payment modalities duly regulated by the Central Bank of Brazil (such as boleto or PIX), the refund will be credited to the bank account of the reservation holder, not allowing credit to accounts held by third parties.
      1. In the event that the Rent Protection is contracted with a credit card, the refund will be made by the acquiring company whenever possible to guarantee the cancellation of the purchase. However, if this action is no longer possible, so that the Customer receives the reimbursement of the same amounts spent, without losses due to possible exchange rate fluctuations, RENTCARS will contact the Customer, who must provide their bank details to RENTCARS for the bank transfer of the total amount spent on the product in the official currency of the Customer's country of residence, according to the provisions of item 5.8 of this Regulation.
    3. The cancellation can only be made by the reservation holder, that is, by the same person responsible for the contract, to prevent fraud.
    4. From the moment the vehicle is picked up, RENTCARS is already preparing to reimburse the deductible amount if necessary. For this reason, the service is considered used from the moment you pick up the car keys, and therefore, cancellation is not possible after the rental has started.
  5. REIMBURSEMENT: LIMITS, PROCEDURE, AND DEADLINES
    1. The amount to be reimbursed to the Customer for triggering Rent Protection will be equal to the total amount paid as an insurance deductible to the Rental Company, limited to R$10,000.00 (ten thousand Reais), excluding any other charges made by the Rental Company, such as, but not limited to fees, fines, mediation fees, and any others.
    2. If the deductible payment amount exceeds the product limit, which is R$10,000.00 (ten thousand Reais), RENTCARS will reimburse this maximum amount of ten thousand Reais, and nothing more will be owed to the Customer.
    3. A reimbursement request is not allowed if no insurance deductible payment is made, even if the Customer makes any payment to the Rental Company, including for damages to the vehicle, as our product exclusively reimburses deductible amounts.
    4. The maximum period for requesting the Rent Protection reimbursement is 30 (thirty) days from the date of payment of the insurance deductible to the Rental Company or a third party indicated by it. After this period, if the Customer has not made the request or, having made it, has not presented all the necessary documentation, RENTCARS understands that the Customer has waived the credit, reserving the right not to make any payment to the Customer or any third party.
    5. To request reimbursement, the Customer must present the following documentation for analysis and verification of authenticity: (i) rental contract; (ii) copy of the driver's license of the person who was driving the vehicle at the time of the claim; (iii) damage report and any images (if any); (iv) invoice or other final billing document issued by the Rental Company; (v) proof of payment of the final amount charged by the Rental Company; (vi) police report or other official document reporting the claim to the authorities.
    6. The request must follow these steps:
      • STEP 1: Activate the insurance contracted directly with the Rental Company;
      • STEP 2: Pay the insurance deductible to the Rental Company;
      • STEP 3: Send the documentation indicated in item 5.5 above to the email [email protected], respecting the maximum period of 30 (thirty) days from the date of payment to the Rental Company;
      • STEP 4: Receive your reimbursement!
    7. The absence of any of the documents listed in item 5.5 above authorizes RENTCARS to refuse payment due to non-compliance with the conditions of this regulation, which have contractual force between the Customer and RENTCARS for all legal purposes.
    8. Regardless of whether the deductible was paid in foreign currency or national currency, the reimbursement paid by RENTCARS will observe the following rules:
      1. Reimbursement will be paid in national currency (Real) for Customers residing in Brazil;
      2. Reimbursement will be paid in Euros for Customers residing in European Union countries.
      3. Reimbursement will be paid in United States Dollars (USD) for Customers residing in any other countries different from those mentioned above;
    9. The payment referred to in the previous item will follow the official commercial exchange rate of the Central Bank of Brazil on the day the Customer made the payment to the Rental Company. Exchange rates applied by credit card operators will not be considered.
    10. The payment of Rent Protection is made exclusively to the bank account of the same holder of the vehicle rental contract with the Rental Company, even if the driver responsible for the claim is one of the additional drivers indicated in the rental contract, and payment to any third parties, including family members or attorneys, is not authorized to avoid fraud.
    11. As the Rent Protection payment is made by bank transfer, the person responsible for the reservation must have a bank account capable of receiving this operation.
    12. If the Rental Company, for any reason, reimburses the deductible costs after the Rent Protection reimbursement request to RENTCARS, this compensation must be immediately reported to RENTCARS, so that the reimbursement request can be canceled, as there would be no actual payment by the Customer.
      1. If the reimbursement by the Rental Company occurs after the payment by RENTCARS, you must contact to return this amount to RENTCARS.
      2. If RENTCARS becomes aware of the reimbursement by the Rental Company without communication by the Customer for the return of the amount paid by RENTCARS, the following measures may be applied at the sole discretion of RENTCARS: (i) blocking access to the App and Site for new reservations, (ii) seeking restitution of the payment by all legally provided means, (iii) including this charge in the next reservation made by you on the App or Site.
  6. DATA PRIVACY
    1. We are committed to protecting our Customers' personal information. We collect and process information as described in our Privacy Policy, available at https://www.rentcars.com/en/info/privacy.
  7. APPLICABLE LAW AND JURISDICTION
    1. This regulation will be governed and interpreted in accordance with Brazilian laws. Any disputes will be resolved in Brazilian courts.
